Introduction
This agreement (“Agreement”) sets forth the terms and conditions that apply to the purchase of products and/or services (the “Products”) from loupTerrible Inc. (“loupTerrible”) using the www.loupterrible.com website. loupTerrible reserves the right to change these terms and conditions without prior written notice at any time, at loupTerrible’s sole discretion.
The terms “you” and “your” refer to the purchaser of Products using the www.loupterrible.com website.
Please read this agreement carefully! By using this website to make online purchases, you agree to be bound by and accept the terms and conditions set forth in this agreement, and you confirm that you are of legal age to enter into this agreement. This agreement contains important information about your rights and obligations, as well as limitations and exclusions that may apply to you. This agreement also contains a dispute resolution clause, found in Section 11.
Except as expressly provided in this agreement, loupTerrible does not make or give any representation or warranty with respect to the products you may purchase from this website, and loupTerrible’s liability is limited as outlined in Section 7.
Your use of this website is also governed by separate Terms of Service and our Privacy Policy (the “Other Policies”). You acknowledge that you have read the Other Policies and agree to their terms and conditions. However, the provisions of this Agreement (particularly the dispute resolution provision in Section 11) shall take precedence over the provisions of the Other Policies in the event of any inconsistencies. Certain additional terms and conditions may apply to purchases of Products or other uses of portions of this website.
Products and Services
loupTerrible offers a variety of clothing and accessories. We strive to describe and display our products as accurately as possible. However, we cannot guarantee that all descriptions are completely accurate, current, or error-free.
Purchase and Payment
All prices are quoted in Canadian dollars (CAD). While loupTerrible strives to provide accurate product and pricing information, errors may occur. loupTerrible reserves the right to correct any pricing or product information errors and to modify prices at any time without prior notice.
By placing an order on our website, you agree to pay the stated price for the product, along with any applicable taxes and shipping fees. We accept various forms of payment as indicated on our website. Your transaction may be subject to validation checks and authorization by your payment card issuer.
Product Availability
The availability of certain Products may be limited, and Products may not be available for immediate delivery. loupTerrible reserves the right to revise or discontinue any Products at any time without notice. If a Product is unavailable, loupTerrible will notify you by email, and your order will be automatically canceled for the unavailable Product.
Shipping and Delivery
- We ship to most locations within Canada but do not deliver to PO Boxes.
- Orders are shipped using reliable carriers, such as UPS, Canada Post, or FedEx.
- Shipping fees and delivery times may vary depending on your location and the shipping method selected during checkout.
Risk and Title
- The product(s) will be at your risk from the time of delivery.
- Ownership of the product(s) will only pass to you once we receive full payment, including delivery charges, or upon delivery, whichever is later.
Returns and Exchanges
Returns:
- Products can be returned within 14 days of the delivery date. To be eligible for a return, items must be unused, in their original condition, and in their original packaging. To initiate a return, please contact us at cs@loupterrible.com.
- Return shipping costs are your responsibility and are non-refundable.
Exchanges:
- If you wish to exchange an item for a different size or color of the same item, contact us at cs@loupterrible.com and send the item to the specified address. Shipping costs for exchanges are also your responsibility.
Refunds:
- Once we receive and inspect your returned item, we will notify you of the approval or rejection of your refund. If approved, your refund will be processed, and a credit will be applied to your original payment method within a specified timeframe.
Exclusion of Warranties and Limitation of Liability
Except as expressly provided in this agreement, loupTerrible makes no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. loupTerrible shall not be liable for indirect, incidental, or consequential damages arising from the use of this website or its products.
Intellectual Property
All content on this site, including text, graphics, logos, and images, is the property of loupTerrible or its suppliers and is protected by copyright and international conventions.
Governing Law and Jurisdiction
This website and its server are located in the Province of Quebec, Canada. This Agreement is governed by the laws of Quebec and applicable Canadian laws.
Dispute Resolution
Disputes will be resolved through binding arbitration under the rules of the Arbitration Institute of Canada.
